These terms and conditions of sale apply to all sales of products marketed by Capri & Positano Life Charter through the website cpcharter.com.
Therefore, all purchase contracts made through cpcharter.com will be governed by these General Conditions.
1. Changes to the Terms and Conditions
This agreement may be modified at any time, and any changes will take effect immediately after being published on the website cpcharter.com. Therefore, the Customer is required to check this agreement each time they access the site and to comply with any subsequent modifications.
2. Acceptance of the Terms of Sale
The contract between the Customer and Capri & Positano Life Charter, a brand of Nautica 21 Nodi srl (owner of the website cpcharter.com), is concluded with the acceptance, even partial and at its sole discretion, of the order. Acceptance is considered implicit unless otherwise communicated to the Customer by any means. In case of non-acceptance of the order, cpcharter.com undertakes to promptly inform the Customer.
By placing an order, the Customer declares that they have read all the information provided during the purchase process and fully accept the general conditions and payment terms outlined below.
The Customer is not entitled to any compensation for damages, nor to any contractual or extra-contractual liability for direct or indirect damages to people and/or property resulting from the non-acceptance, even partial, of an order.
3. Purchase Methods
The Customer, who must be of legal age, may purchase the products available in the electronic catalog of cpcharter.com.
Once the order has been placed, a confirmation email will be sent to the email address provided by the Customer. The confirmation email will include an “Order Number” to be used for any further communication with cpcharter.com.
The email will contain all the data entered by the Customer, who must verify their accuracy and promptly report any corrections according to the procedures described in this document.
All prices listed on the website include VAT unless otherwise specified. cpcharter.com reserves the right to change prices at any time without prior notice.
4. Payment Methods
a) ADVANCE PAYMENT BY BANK TRANSFER
In the case of advance payment by bank transfer, the order will be shipped only after the amount has been credited to the account of Capri & Positano Life Charter (owner of the website cpcharter.com) within 5 business days from the purchase date. After this period, the order will be automatically canceled.
The transfer description must include the order number indicated in the confirmation email. The bank details will be sent via email upon acceptance of the order.
b) PAYPAL
Once the order is confirmed, the Customer will be redirected to the PayPal website, where they can complete the payment using their PayPal account, a credit or prepaid card, or any other method accepted by PayPal, in accordance with its terms and conditions.
If the order is canceled by the Customer or Capri & Positano Life Charter, the amount paid for the canceled products will be refunded to the Customer’s PayPal account.
c) STRIPE
Once the order is confirmed, the Customer will be redirected to the Stripe website, where they can complete the payment using a credit or prepaid card, Google Pay, Apple Pay, or any other method accepted by Stripe, in accordance with its terms and conditions.
If the order is canceled by the Customer or Capri & Positano Life Charter, the amount paid for the canceled products will be refunded to the Customer’s Stripe account.
For every order placed on luxuryboatspositano.com, an invoice will be issued in compliance with Article 14 of D.P.R. 445/2000 and Legislative Decree 52/2004. The invoice will be sent to the purchaser along with the products. The data provided by the Customer will be used for issuing the invoice. Capri & Positano Life Charter reminds the Customer to carefully verify the accuracy of the information provided. Once the invoice has been issued, no modifications can be made.
9. Limitation of Liability
Capri & Positano Life Charter (owner of the website cpcharter.com) is not responsible for any errors, omissions, technical inaccuracies, or typographical errors present on the website or for any interruptions to web services.
10. Links to Third-Party Websites
The links present on the site allow access to other websites that are not under the control of Capri & Positano Life Charter. Capri & Positano Life Charter is not responsible for the content of such linked sites.
11. Applicable Law and Jurisdiction
Any dispute relating to the application, execution, interpretation, and violation of the contract concluded online between the Customer and Capri & Positano Life Charter, part of the Nautica 21 Nodi srl group (owner of the website cpcharter.com), is subject to Italian jurisdiction. The competent court is that of the Customer’s residence or domicile if located in Italy, or the place of contract execution in the case of residence or domicile abroad.
12. Partial Invalidity of the Conditions
If for any reason any part of these terms and conditions is found to be unenforceable, the validity of the remaining provisions will not be affected.
